Privacy Policy

1. Information we collect

• Discord account data: your Discord user ID, username, and server roles when you join the server or link your account.
• Account and billing: if you become a paid Member, your email address and payment details are handled by Stripe. Full card numbers never touch our servers; Stripe is the processor of record and shares limited billing data with us (such as subscription status, card brand and last four digits, and your email).
• Usage and activity data: server activity such as messages sent, slash commands used, and role assignments, used for moderation and product analytics. Retained for 90 days, after which it is deleted or anonymized, unless a specific safety investigation or legal obligation requires us to keep it longer.
• Technical data: IP address, approximate location, browser and device information, and referring pages, collected through our server logs and analytics for security, abuse prevention, and understanding traffic.
• Support and moderation records: the content of support requests and moderation-relevant activity, kept to provide support and keep the community safe.

We collect this information from you directly (for example, when you join the server or contact support), automatically from your device and our logs (technical and usage data), and from our service providers (Discord and Stripe). We disclose personal information only to the service providers listed in Section 4 (Stripe, Discord, and Cloudflare), and to authorities where required by law, for the business purposes described in Section 3. We do not disclose your personal information to third parties for their own marketing.

2. Analytics and cookies

We use two privacy-friendly, cookieless analytics tools that measure traffic in aggregate and do not build advertising profiles of you:

• Our self-hosted analytics, which records aggregate pageviews and basic events. IP addresses are used transiently for purposes like de-duplication and rough geography, not to identify you personally.
• Cloudflare Web Analytics, a cookieless measurement tool. See Cloudflare's privacy policy.

Our website does not set its own advertising or tracking cookies. Third-party services you interact with, such as Discord and the Stripe checkout, may set their own cookies on their own pages, governed by their respective policies.

3. How we use your information

• Operate, maintain, and secure the Discord community and the Service.
• Process Member subscriptions, billing, and support requests.
• Detect, prevent, and investigate abuse, fraud, and violations of our guidelines.
• Send service-related emails (receipts, billing and account notices, recovery links, and important policy changes). We send promotional or marketing email only if you opt in, and you can opt out at any time.

Where the GDPR or UK GDPR applies, we rely on these legal bases: performance of our contract with you (providing the Service and billing), our legitimate interests (security, abuse prevention, and improving the Service), your consent (for example, opt-in marketing), and compliance with legal obligations.

4. How we share your information

• Stripe: payment processing. See Stripe's privacy policy.
• Discord: the platform the community runs on; your activity there is also governed by Discord's privacy policy.
• Cloudflare: analytics and security/infrastructure. See Cloudflare's privacy policy.
• We may disclose information if required by law (for example, a subpoena or valid government request) or to protect the rights, safety, or property of our members or the Service.

When you follow a link to Stripe, Discord, Cloudflare, or a retailer we mention, you leave our Service, and that site's own terms and privacy policy apply; we are not responsible for its content or practices.

We do not sell or rent your personal information, and we do not share it for cross-context behavioural advertising.

5. Where your data is stored, and international transfers

Our servers and database are located in the United States, and our service providers may process data in the United States and other countries. If you are in the EU or UK, Canada, Australia, or elsewhere, your information will be transferred to and processed in the United States. Where required, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, for these transfers.

6. How long we keep it

We keep personal information only as long as needed for the purposes above. Financial and transaction records are retained for as long as required by applicable tax and accounting law. Usage and activity data is kept for 90 days, after which it is deleted or anonymized, unless a specific safety investigation or legal obligation requires us to keep it longer. We delete or anonymize other account data when it is no longer needed or when you ask us to.

7. Your rights

Depending on where you live, including under the GDPR and UK GDPR (Europe), the CCPA/CPRA (California), PIPEDA (Canada), and the Privacy Act 1988 (Australia), you may have the right to access, correct, delete, or receive a portable copy of your personal information; to object to or restrict certain processing; to withdraw consent; and, for California residents, to opt out of any "sale" or "sharing" (we do neither) and not be discriminated against for exercising your rights. To exercise any of these, email privacy@pokegemhq.com. We respond within 30 days and may need to verify your identity. You also have the right to complain to your local data-protection authority. Note that requesting deletion will end your Discord access and any active Member subscription.

8. Security

We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and the relevant authorities where required by law.

9. Children

The Service is intended for users 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

10. Changes to this policy

We may update this policy from time to time. Material changes will be posted in the Discord announcements channel and reflected in the "Effective" date above.

We encourage you to review this policy periodically. Continued use of the Service after an update means you acknowledge the revised policy.
